Our In-House Protection Plan will provide you with worry-free solar care. Sun Kissed Energy customers automatically receive a complimentary first year worry free In-House Protection Plan. Customers may cancel their service plan at any time.
Sun Kissed Energy will repair or replace the system, at Sun Kissed Energy’s own discretion, including the cost of labour, if it proves to be defective in material or workmanship for a period of 1 year from the service plan start date under normal application, installation, use and service conditions.
Nothing in this service plan is meant to promise a specific power output of a solar system installed by Sun Kissed Energy. Sun Kissed Energy disclaims any representation or warranty about the output of any solar system subject to this Protection Plan. Furthermore, Sun Kissed Energy is not liable for any lost electricity production by the Customer as a result of the delay in effecting a repair or replacement of the Customer’s solar system, including without limitation any amounts in respect of the Customer’s lost profits from not being able to sell electricity into the grid or the Customer’s expenses from having to purchase additional electricity from the grid.
Sun Kissed Energy will not be liable or responsible to a Customer under this service plan for any failure or delay in their performance under the terms of the service plan when and to the extent such failure or delay is caused by or results from acts or circumstances beyond Sun Kissed Energy’s reasonable control, including, without limitation, a physical event or condition not known at the time the solar system was purchased, acts of God, flood, fire, earthquake, tsunami, explosion, governmental actions, regulations or controls, war, invasion or hostilities (whether war is declared or not), terrorist threats or
acts, riot or other civil unrest, national emergency, revolution, insurrection, epidemic, pandemic, lockouts, strikes or other labour disputes (whether or not relating to our workforce), or restraints or delays affecting carriers or inability or delay in obtaining supplies of adequate or suitable materials, materials or telecommunication breakdown, or power outage.
How this service plan applies:
This service plan does not provide coverage for any type of general maintenance of solar systems.
Sun Kissed Energy customers who alter the solar system installed by Sun Kissed Energy in any manner, including but not limited to, upgrade their electrical, repair their roof, remove solar panels or other system parts, or have any contractors modify any existing structures that may or may not affect the integrity of the Sun Kissed Energy solar system, are required to notify Sun Kissed Energy prior to making any such upgrades or modifications and obtain Sun Kissed Energy’s consent to such modification. Failure to obtain Sun Kissed Energy’s consent will void any and all coverage under this service plan. In order to maintain coverage under this service plan, Sun Kissed Energy recommends
they be consulted to remove, alter, disconnect or change the solar system in any way. Such action taken by any other contractor or person will automatically result in this service plan becoming null and void.
Some examples of issues not covered by this service plan are listed below. This listing is not meant to be all inclusive and the Customer acknowledges there may be additional situations or circumstances that result in this service plan not applying.
Systems that have had a serial number or any part thereof altered, defaced, or removed.

Except to the extent prohibited by applicable law, the Customer agrees they shall not bring any action or make any claim under this service plan, regardless of form, arising out of or in any way connected with this service plan, more than two (2) years after the event or damage has occurred.
The Customer agrees that any and all claims of any type whatsoever which the Customer has or may have against Sun Kissed Energy under this Protection Plan or in any way related to the
obligations of Sun Kissed Energy under this Protection Plan shall be limited to the initial cost to the Customer of the solar system installed by Sun Kissed Energy, excluding HST.
Sun Kissed Energy retains the right to amend the provisions, clauses, or applications of the Protection Plan from time to time without notice, however, such changes would not be retrospective.
The Protection Plan for any particular solar system provided by Sun Kissed Energy has a maximum time limit of (25) twenty-five years, commencing on the initial installation date of the Customer’s solar system. As a result, a Customer’s Protection Plan shall immediately be considered void as of and upon the (25th) twenty-fifth anniversary of the installation of that solar system.
In order to maintain coverage under the Protection Plan, each Customer must allow Sun Kissed Energy to perform an inspection of the solar system at Sun Kissed Energy’s discretion from time to time to determine whether the solar system remains eligible for the Protection Plan, which eligibility will be determined by Sun Kissed Energy in its absolute discretion. The first such inspection shall take place no later than the (5) five-year anniversary of the initial installation of the solar system.
